Terms and Conditions

By accessing and using our website at www.autismsupportdirectory.com.au, including the Listing Services we provide, you agree to comply with these Terms and Conditions, along with any other policies or documents referenced or linked on our site.

These Terms form an agreement between you (the business or supplier seeking to create a Listing or advertise on our website) and us, the Autism Support Directory [ABN 72 350 144 356] (“we”, “us”, or “our”).

If you do not agree to these Terms and Conditions, you are not permitted to create a Listing or use our Listing Services.

1. THE LISTING SERVICES WE WILL PROVIDE

We will deliver our Listing Services with due care, skill, and diligence, and in accordance with all applicable laws, regulations, and the requirements of relevant authorities at the time of service. Where appropriate, we will seek confirmation or consent from your authorised representative in relation to your Listing.

Businesses meeting any of the following criteria are ineligible for Listing: 

  • Independent Support Workers

  • Businesses that have received an infringement notice, banning order, compliance notice, enforceable undertaking, or have had their NDIS registration suspended or revoked

  • Businesses whose services are clearly misaligned with neurodiversity-affirming values. This includes providers that promote the idea of “fixing” or “treating” autism, or that offer ABA-based therapies, which are not eligible for a Listing

2. HOW IT WORKS

To use our Listing Services, you must first create an account on our website, then complete and submit a Business Listing with your relevant details. All Listings are subject to review and approval. Once approved, your Listing will be published on the Directory.

We reserve the right to reject, suspend, or remove Listings at any time if we believe they are in breach of these Terms and Conditions or any other applicable policies.

Please note, you must be 18 years of age or older to access and use our Listing Services.

3. YOUR OBLIGATIONS

You must provide all Information required by us in order for us to provide the Listing services. You represent and warrant that:

  • you are a neurodiversity-affirming business and provide services with a neurodiversity-affirming approach*;

  • all information provided in relation to your business is true, correct, and accurate, including (but not limited to) service and/or product descriptions, professional qualifications, professional body registrations, and NDIS registration status;

  • the Information is not misleading or deceptive;

  • the Information does not breach any third-party Intellectual Property Rights;

  • your business holds, and will maintain, all relevant insurances, registrations, and qualifications required to legally provide the services included in your Listing. You agree to comply with all applicable legislation and regulations, including but not limited to the Australian Consumer Law and the National Disability Insurance Scheme Act 2013 (if offering services through the NDIS);

  • you accept responsibility for informing the Autism Support Directory of any changes to the information provided, including (but not limited to) changes to professional body registration, NDIS registration status, or any infringement notices or compliance/enforcement actions issued by the NDIS;

  • you will respond promptly to any of our requests for further information and provide any approvals within a reasonable time; and

  • the Representative has full authority to make all decisions related to the Listing Services;

  • You consent to the Autism Support Directory undertaking the following verification steps (for the purpose of duty of care):

    • Verification of ABN or ACN
    • Verification of NDIS registration (where applicable)
    • Verification of registration with the relevant professional body (where applicable)
    • Check of the NDIS Infringement Notice List and Compliance and Enforcement Actions Register

*Neurodivergent-Affirming Practices

For the avoidance of doubt, neurodivergent affirming practices are those in line with the guidelines and definitions included in 1) the National Autism Strategy (2025-2031) and 2) the National Guideline For Supporting the Learning, Participation, and Wellbeing of Autistic Children and Their Families in Australia (December 2022), as detailed below:

1) National Autism Strategy (2025-2031) 1

Guidelines around neurodiversity-affirming practices: The foundations for the National Autism Strategy include ‘improving services and supports so they are neurodiversity-affirming, inclusive and appropriate for the Autistic community.

Neurodiversity-affirming definition: The Glossary defines ‘Neurodiversity-affirming practice’ as: ‘a strengths and rights-based approach to brain differences that can take many forms depending on each person’s needs and context. It promotes safety through accepting and valuing differing ways of thinking, learning, communicating and experiencing the world. Rather than trying to ‘fix’ or change neurodivergent people to fit into a narrow idea of what is considered ‘normal’ or ‘better’, neurodiversity-affirming practice aims to provide supports, services, accommodations and adjustments that are person-centred and affirm neurodivergent identity and individual needs.’

2) National Guideline For Supporting the Learning, Participation, and Wellbeing of Autistic Children and Their Families in Australia (December 2022) 2 

Guidelines around neurodiversity-affirming practices: The Guiding Principles for providing supports to autistic children includes the direction that practitioners should work in ways that are neurodiversity-affirming and includes five specific recommendations involving neurodivergent-affirming practices. 

Neurodiversity-affirming definition: The Glossary defines ‘Neurodiversity-affirming’ as: ‘Practices that seek to affirm the child’s neurodivergent identity. In the context of autism, this term refers to providing supports that embrace each child’s unique understanding of other people and the world around them, without seeking to ‘cure’ autism.’ 

4. FACILITATOR ONLY

We are not involved in the relationship, communication, or transactions between you and your clients or customers. Our role is limited to facilitating visibility and connection through the Directory and related platforms (including social media or email, where applicable). Any further engagement is solely between you and the individual or organisation. If a dispute arises between you and a customer or client, it is your responsibility to resolve the matter directly with them. You agree to release us from any and all claims, liabilities, or losses arising out of or in connection with such disputes.

We do not actively monitor all content submitted to or displayed on our Listing Service and accept no responsibility for any unauthorised, inaccurate, or unlawful content submitted by third parties. However, we reserve the right to remove any content that we become aware of that breaches our Terms or relevant laws.

5. RIGHTS IN YOUR CONTENT

When you provide us with your Information and any other content, including but not limited to any photos for your Listing and/or advertising on our website, you grant us permission to display this Information and content on our website (www.autismsupportdirectory.com.au), until the time that your Listing expires or you withdraw permission in writing via email.

Your Information and content will not be displayed, reproduced or broadcasted on any third-party platforms by us, without your consent.

6. YOUR OBLIGATIONS AND CONTENT RULES

You must conduct yourself appropriately when using our Listing Service, including being respectful and courteous to all customers and clients, and when interacting on our website.

If you provide or post any of the following content we may, at our sole discretion remove your Listing and/or adverts or terminate this Agreement:

  • any inappropriate or offensive content including but not limited to, any insults or profanity, conduct that is religiously, racially, or sexually offensive, or threatening or abusive, or that impersonates, stalks, or harasses another user;

  • any illegal content including, but not limited to, anything defamatory, and any post that breaches third party Intellectual Property Rights;

  • any immoral content including but not limited to, anything pornographic or obscene;

  • any false or misleading content; or

  • any copying, modifying or distributing of any other business’s content without their consent

If we consider that your business is not neurodivergent-affirming, we may also remove your Listing at our sole discretion.

If you breach these content rules, we may delete your Listing and/or advert and terminate this Agreement.

If you consider that someone is breaching the content posting rules, please notify us at admin@autismsupportdirectory.com.au promptly so that we can address the issue immediately. 

7. COMMISSION & FEES

The Autism Support Directory does not charge any commission or take a percentage of any fees earned by businesses through connections made via the Directory. Listing fees are charged as a monthly subscription, based on the selected Listing Package, and are fixed and transparent. Any engagement, bookings, or transactions that occur between a business and a client or customer are independent of the Directory, and we do not take part in or profit from those arrangements.

8. PAYMENTS FOR LISTING PACKAGES 

All Listing Packages are charged as monthly subscriptions, with payments processed securely via Stripe. By subscribing to a Listing Package, you agree to the applicable fees and billing schedule.

9. CANCELLATIONS AND REFUNDS

You may cancel your subscription at any time before the automatic monthly renewal via the user dashboard on the website.  We do not provide any pro rata refunds.

Payments are not refundable unless expressly stated otherwise or required by law. Where there is an issue with our Listing services (e.g. technical issue) we may refund your current monthly payment.

10. NO GUARANTEES

We do not guarantee the accuracy of the content in our Listing Services.

We do not guarantee that you will receive an increase in customers, clients, bookings, social media exposure or revenue.  Social media posts are shared at our discretion.

Except as required by law, we do not warrant the quality of the Listing service or warrant that it will meet your expectations. We do not guarantee that you will receive any certain number of Listing views, that you will receive any certain number of enquiries from your Listing, or the suitability/quality of enquiries.

You acknowledge and agree that your Listing and any advertising may be listed next to your competitors; we cannot guarantee that your Listing or advertising will be independent of other competitors.

If you choose to link Google or Facebook reviews to your Listing, please note that we have no control over the content of these reviews and are not responsible for their accuracy or moderation. All reviews remain the responsibility of the platform on which they are published.

11. MARKETING

You grant us permission to use any testimonials you provide (via email or other means) for marketing, promotional, or informational purposes.

You must seek our prior written consent before any publication about us. 

12. TERMINATION AND CANCELLATION

You can request that we remove your Listing and/or advert at any time, and we will honour your request and remove your Listing and/or advert as soon as reasonably possible.

We may refuse to provide Listings and/or advertising to you, or anyone, for any reason, at any time. In particular, if you breach this Agreement, we may immediately terminate this Agreement and remove your Listing and any advertising. 

We can also stop offering our Listing Services at any time, for any reason, and without notifying you. We are not responsible to you for any changes, or if we suspend or stop our Listing Services.

13. LIABILITY AND INDEMNITY

Your use of, or inability to use our Listing Service is at your sole risk. To the maximum extent permitted by law, we are not liable for any Loss or Damage arising from your Listing and/or advertising including, but not limited to, any errors or omissions in any content, any price changes or discontinued Listing Services, any removal of your Listing and/or advertising and any interruptions, any changes to our website.

To the extent which we are entitled to do so, our liability under the Australian Consumer Law will be limited, at our option to:

  • the supply of equivalent Listing Services E.g.: another opportunity to list your business, products, or services; or

  • the refund of the Fees.

In any case, our liability to you will not exceed the amount actually paid by you to us for the most recent Fee.

You agree to indemnify us, and to keep us indemnified from any Claim arising out of or in connection with your Information, your breach of this Agreement, where you provide incorrect information, any lack of results from your Listing, any disclosure of your information, any further meetings or communications with any client or customer, any breach of your Intellectual Property Rights and any direct or indirect consequences of you accessing or using the website.

14. IF THERE IS A DISPUTE 

If a dispute arises, you acknowledge and agree that confidentiality is paramount to our reputation. At no time will any communications or discussions be made public, including but not limited to any social media websites. Any public discussion or comments considered defamatory, negative, or otherwise damaging and will be the subject of compensation in any mediation or litigation claim. In the event of any dispute that cannot be resolved, both parties agree to obtain an independent professional arbitrator/dispute resolution specialist to make a determination on the dispute and each party agrees to pay their own costs.

15. OTHER

This Agreement is to be construed in accordance with the laws of Queensland, Australia, and you and we submit to the jurisdiction of the courts of Queensland, Australia. This is the entire Agreement between you and us, and supersedes any prior agreements, proposals, and communications whether oral or written, between you and us. In the event of an inconsistency between this Agreement and other terms and conditions on our website, these Terms and Conditions prevail. No other term is to be included in this Agreement except where it is required to be included by law. The failure by us to exercise any right or enforce any provision in these Terms and Conditions does not waive the future operation of that right or provision. In the event that a provision in this Agreement is not enforceable, such provision shall be severed from this Agreement to the extent permitted by law, and the remaining provisions will remain in full force and effect. All obligations and liabilities in these Agreement survive termination of this Agreement.

DEFINITIONS

“Agreement” means these Terms and Conditions and all other terms and conditions, and policies published or linked to on our website in future.

“Australian Consumer Law” means the Competition and Consumer Act 2001 Schedule 2.

“Claim” means any claim, under statute, tort, contract or negligence, any demand, award, or costs.

“Copyright” means the copyright as defined under the Copyright Act 1968 (Cth). 

“GST” means goods and services tax as applicable pursuant to Australian laws.
“Information” means all your business information, and any product and services information for your listing, including but not limited to website details, logo, images, links, social media platforms and brochures/pamphlets.

“Intellectual Property Rights” means all copyright, trademarks, design rights, patents, trade secrets and confidential information whether registered or unregistered.

“Listing” means the entry listed on our website for your business.

“Listing Services” means the listing service on our website that we agree to provide to you, and any additional services including any advertising.

“Loss or Damage” means any direct, indirect, incidental, punitive, special, or consequential loss or damages of any kind, including but not limited to, any loss of profits, loss of goodwill, loss of business reputation, revenue, savings, loss of data, loss of enjoyment, virus to systems, personal injury, death, negligence, trespass, property damage and legal costs. 

“Moral Rights” means all moral rights as defined under the Copyright Act 1968 (Cth). 

“Your Representatives” means the person you notify us has authority to make decisions in relation to the Listing Services.

“We, us, or our” means Autism Support Directory [ABN 72350144356] and includes any of our employees, agents, partners, and contractors.

“Website and Listing Services” means www.autismsupportdirectory.com.au, and everything available on this website including, but not limited to, the Listing Services.
